Jack Gilbert, Michael at Bing; Bing will either manually override and alter the HUGE database or face a jury award for neglecting this advisement and continuing to violate Neeley’s privacy and associate this nude image with Neeley’s name at schools. Michael “checked further” on the link to http://www.bing.com/images/search?q=curtis+neeley&view=detail&id=ABBEC5D7FF89C0D7A05C8790D16E4925E61D000D&first=0&FORM=IDFRIR and imagined a comment? Where on the page did Michael imagine finding this comment by Neeley? Visitors to the page find no comment that was only imagined by Michael at Bing. Visitors to the page do NOT see the file name for the image of “curtis_neely.jpg”. Visitors do not generally see the link to {michelle7-erotica.com/members/001/0802/curtis_neeley/gallery_1.htm} although this is seen by visitors who mouse-over the image and read the link. THERE ARE ABSOLUTELY NO USES OF “curtis neeley” ON THE LINKED PAGE AND NO COMMENT, NONE AT ALL! MSFT “bots” access the webpage and were not precluded by the robots.txt. The fact that the webpage is accessible to the PUBLIC does not mean Curtis J Neeley Jr., MFA agreed to have the content copied by MSFT and associated with Neeley’s personal name elsewhere like in public schools. i.e. Failing to lock a vehicle when visiting a grocery store leaves the vehicle “accessible” to the public. This failing to lock the vehicle does not request that the public intrude into the vehicle. The lack of a “lock” on this page does not seek the page’s bare code being taken apart by “bots” and then represented in a new contexts at other websites. Namely in a name search at Bing while at school. The PUBLIC looks at {michelle7-erotica.com/covers/2002/02/index.php} and encounters the nude image in an entirely different context than schoolchildren. Children at school are not generally going to access {michelle7-erotica.com/covers/2002/02/index.php}. Children at school are infinitely more likely to type their father’s name into MSFT searches at school. Bing will either manually override and alter the HUGE database or face a jury award for neglecting this advisement and continuing to violate Neeley’s privacy and associate this nude image with Neeley’s name. Google Inc already claimed to have spent hundreds of thousands in legal fees and Microsoft Corporation will soon join them and has chosen to spend money now in legal rather than manually override and alter the HUGE database. MSFT might be interested in the fact that Neeley has sought to have 47 U.S.C §230(c)(1) declared unconstitutional. There is no robots.txt file at michelle7-erotica.com at this time. The following text would preclude the “bots” from violating the content of this INDIVIDUAL page. This 373 byte file is also attached. Please, Mr Gilbert, either remove Neeley’s name from the page’s code entirely and/or include a robots.txt like follows and like is attached? I spoke with Wikimedia Foundation legal and the page MSFT links does not have the text "curtis neeley"! See "curtis neeley" searches. From: Microsoft Customer Support [mailto:SERCH.SRCH.WW.00.EN.NCO.QUE.TS.T01.SPT.00.EM@css.one.microsoft.com] Hi Curtis, Thank you for writing back. My name is Manny from Bing Technical Support. I am sorry to hear that you are disappointed by our denial to your image removal request. Please know that we do not remove Web pages from our search index on request. Our search index reflects the content on the Internet and is built from billions of documents on millions of Web sites around the world. We want our search index to represent the content of the Web as accurately as possible. Our search index only reflects what is published on the Web. We depend on automated collection of pages from public Web sites, and we avoid manual intervention or overrides because we cannot manually maintain a large search database. In addition, please contact the site owner of http://cs.wikipedia.org/wiki/Akt_(v%C3%BDtvarn%C3%A9_um%C4%9Bn%C3%AD) because as long as the image is live, search engines will be picking up this information and include them in their search results. The complex algorithmic process of GOOG and MSFT will now be sought as evidence in: Microsoft Corporation or Bing is now being advised that they have been sued in United States Court for the Western District of Arkansas for violating Neeley's privacy and publishing data that would obviously rather be maintained privately. The two files that are sought deleted were copied by Microsoft Corporation entirely uninvited by Neeley. Redisplay of these nude images in "curtis neeley" image searches by Bing violates many state and national laws as well as the Berne Convention for the Protection of Literary and Artistic Works. 1. http://ts4.mm.bing.net/images/thumbnail.aspx?q=4695400553908315 (last four of 7315) The preceding two files are nudes that were COPIED using the "mysterious algorithmic process" by BING and this process was never authorized by the author in violation of the author's exclusive rights to control creations that are not protected currently by United States law. This missing constitutionally authorized right is the reason the United States is a defendant along with Microsoft Corporation, Google Inc and the FCC. Neeley will now point MSFT, GOOG, the United States, as well as the FCC all in the right direction. Deleting these files now mitigates the damages sought. Refusing to delete these is unwise whether displayed by others or not. Deleting these files could still result in dismissal until 12:00 CST 5/25/2012. -GET BUSY! http://www.curtisneeley.com/Google/Booklet-Complaint.htm <<in HTML Jack, Microsoft Corporation counselors, Brad, Neeley hopes to have "pointed" MSFT in the right direction. Google Inc and NameMedia Inc have filed oppositions to the motion to proceed IFP and these oppositions are NOT frivolous but are "hail Mary" attempts to prevent being served. MSFT might consider opposing the motion in court also though not yet served as well. The claim of 47 §230(c)(1) preclusion is addressed as unconstitutional in the filing and Neeley is not aware of any other rational for dismissal of MSFT besides quickly complying with the request instead of attempting the same tired justification Google Inc has used.

From: Microsoft Customer Support [mailto:SERCH.SRCH.WW.00.EN.NCO.QUE.TS.T01.SPT.00.EM@css.one.microsoft.com] Hi Curtis, Thank you for contacting Bing Technical Support. I understand that you would like a couple of images removed from Bing. Allow me to point you to the right direction. Indexed content found in Bing relies on a complex algorithmic process. The content is being discovered by our normal organic crawling process that is made available by webmasters/site owners. Bing does not own this content and has no way to validate its authenticity. Should you need to have these images removed, we recommend that you contact the webmaster of the site to prevent the images from being publicly available. You can work with the appropriate legal authorities to get the content removed from the web. If you have any other questions or require further assistance, please feel free to contact us again. Cerah, Michael, Manny, and others at Bing, et al, Mr Neeley was glad the nude image from the following URL was deleted.
The trouble is the deleted image was replaced by the following unauthorized copy.
Lloyd Shanks barn is not a nude image. How on Earth was it involved? A. Bing Query URL “curtis neeley”.
B. Bing thumbnail URLs. C. Bing thumbnail query link URLs.
D. Bing cited source pages with the images remaining but without “curtis neeley” text displayed.
E. Bing third-party image URLs for past preemption of State claims:
F. Bing defamation and indecency broadcast preemption or unconstitutional 47 U.S.C. §230 statute URL.
G. Pending un-served United States Court for the Western District of Arkansas complaint filed against MSFT dba Bing now visible to the Supreme Court on the United States Court’s website accessible by the public via PACER for $.08/page.
H. Free URL mirror of pending United States Court for the Western District of Arkansas complaint filed against MSFT dba Bing.
I. The two pages above in “D” do not contain text that presents “curtis neeley” in any way other than in the source code for the first link. MSFT and Jack Gilbert each receive this exact advisement concurrently as do counselors currently seeking dismissal in “hail Mary” motions. Mr Neeley objected specifically to association of his name with these two nude photographs in searches. The pubic, except “bots”, may see the stolen copies pulled from MSFT servers with inappropriate links at the following URL as well as this email dialog archived by date.
J. Mr Neeley does not feel “Bing” employees have any idea where this is coming from or how sensitive these violations are at this time. These “automatic” repairs would be very simple. MSFT employees at Bing may examine the following three links to search BING and avoid these two websites if searching for “curtis neeley” despite the fact that neither website contains the text “curtis neeley” for display to visitors…
The images associated with “curtis neeley” by Bing are still present at the source websites despite the usage of “curtis neeley” was removed after the December 6 ,2010 US Court order to seek alteration in this manner. See this request at Dkt 216 of the District Court case. The “link” between these images and Mr Neeley exists exclusively because of MSFT “automated” processes from some past content. These links were removed and returned several times over the past three years by MSFT. There are “geeks” who can alter this violation overnight and have in the past as seen by numerous witnesses, Court for the Western District of Arkansas, the Eighth Circuit Court of Appeals Clerks, and numerous Supreme Court Clerks already. Refusal to cease the defamatory associations of the “curtis neeley” searches with these images amplifies the gross negligence award that will now be sought. Neeley Honestly hoped MSFT would respond and be dropped. Mr Neeley prefers MSFT to GOOG and had hoped Microsoft Corporation would comply with this request and continue with image searching after the right to exclusive control of original visual art is finally established in the United States though recognized first in 1787 and NEVER YET DONE. This will be published by wire and be searchable fairly soon. Neeley may be dismissed or not allowed IFP status for the current filing but there is ABSOLUTELY NO CHANCE that this claim will be excused and ABSOLUTELY NO CHANCE that BING, Google Inc or ANY image searches remaining will still exist in two years and still return nude images to the anonymous regardless of where these were found.
Happy Memorial Day, Curtis J Neeley Jr, MFA

MSFT, Donna, Bing Technical Support, Opposing Conuselors, “Complex algorithmic process” is exactly the same as “complex step-by-step process” but it is more correct than the “normal organic crawling process” description. Search engines are mostly simple Perl5 or PHP scripts that search databases and return lists of results. Use of the term “normal organic crawling process” by Technical Support may be an attempt to claim that searches of “websites” is done while responding to the desires of the “website” owners in some “live” manner. Use of the language “crawling process” already attempts to give the searches organic attributes that are in no way warranted. Crawling is an action verb normally used to describe movement by animals or bugs. Any attempt to claim to be working in conjunction with “website” owners is fraudulent. Bing searches “websites” unless the “website” owner has instructed the search “bot” to be excluded and most “website” owners are not aware of how this is done. The search “robots” or “spiders” are not alive in any way and are not organic in any way. Searches are simply the thought processes of programmers or geeks who wrote the programs. The cs.wikipedia.org results are the only remaining violations of my exclusive authors’ rights visible in the “organic” search process today at Bing. The “website” still has the nude image and the disappearance of the search results indicate how the thought processes of programmers or geeks are often revealed. http://cs.wikipedia.org/w/index.php?title=Akt_%28v%C3%BDtvarn%C3%A9_um%C4%9Bn%C3%AD%29&diff=7759689&oldid=7551922 Is the URL call for a record kept by the Wikipedia Foundation that reveals that the text of “curtis neeley” was removed from the “webpage” Bing cites as the rational for returning this nude in searches for “curtis neeley”. December 20, 2011 at 18:13 the text “curtis neeley” was removed from this page and stopped justifying returning of this nude image in “curtis neeley” searches when done by schoolchildren or by anyone else. TODAY this result still occurs! This violation of privacy is despite there being no justification for this result for 148 days and about 23 hours. This is roughly five months and eleven days. This legal process is NOT A GAME and Mr Neeley appreciates the fact that the “curtis neeley” searches today do not return the nude with the link alleging as follows. This was due to the operation of some live programmer or geek decision and was not caused by some other complex algorithmic process. The fact that this nude image does not return in “curtis neeley” searches today is an “organic” result caused by some live programmer or geek. This nude image remains on the prior website where it has been for a DECADE and it remains called curtis%20neely.jpg and is linked to “michelle7-erotica.com/members/001/0802/curtis_neeley/gallery_1.htm” giving this page more rational than the cs.wikipedia.org result that had ABSOLUTELY no use of “curtis neeley” for almost 149 days. Mr Neeley is grateful the live programmer or geek halted this nude image return and will carefully explain the step-by-step process used to a judge or jury. This legal process is NOT A GAME and this thread will be entered into evidence and used to explain how EXTREMELY simple this privacy violation is/was to (be) stop(ped). The Internet is not the “wholly new medium” it was called by the aging John Paul Stephens in 1996. Internet communications are simply unique new uses of one of the oldest methods for distant communications by wire. Internet communications are now simultaneous uses of wire communications and radio communications. Each of the mediums are the duty of the FCC to regulate for public safety when used in interstate or world-wide communications. This legal process is NOT A GAME and the “open Internet” has always been against US law. The Internet has ALWAYS BEEN ILLEGAL! Susan B Anthony was the first woman to ever vote for President in the United States in 1872. Susan B Anthony was fined $100 for doing this by the Supreme Court. Susan B Anthony never paid this $100 fine but died before all women were allowed to vote in the United States in 1920 or 48 years later. Susan B Anthony never gave up her pursuit of women’s suffrage. Congressmen and Senators are investigating the UN Regulating the Internet but 47 USC §232 is on the desk of most of these as well as being submitted as an exhibit in United States Courts. Neeley v NameMedia Inc et al, (5:12-cv-05074) is NOT A GAME! MSFT or Microsoft Corporation or Bing NOW faces Mr Neeley in United States Court for the Western District of Arkansas. The fact that one of the images that MSFT returned with no third-party support does not now return in searches for “curtis neeley” searches after advised in this “thread” has been documented. MSFT or Microsoft Corporation or Bing has not acted maliciously by refusing to halt returns of these two nude images in “curtis neeley” searches after advised the way that Google Inc once did and still does. Ironically, the image searches by Google Inc for “curtis neeley” return only two nudes done by Neeley in the “standard” searches like seen in the following link. http://www.curtisneeley.com/Google/exhibits/curtis%20neeley%20-%20Google%20Search_GOOG_5-29-2012_p46-std.pdf TODAY there is only one nude by Mr Neeley returned today by MSFT that was recorded in the following EVIDENCE QUALITY PDF. http://www.curtisneeley.com/Google/exhibits/curtis%20neeley%20nude%20-%20Bing%20Images_MSFT_5-29-2012_one.pdf YESTERDAY there were two nudes by Mr Neeley returned by MSFT that were recorded in the following EVIDENCE QUALITY PDF. http://www.curtisneeley.com/Google/exhibits/curtis%20neeley%20nude%20-%20Bing%20Images_MSFT_5-28-2012_two.pdf Thank you Bing technical support for halfway fixing the searches for “curtis neeley”. It is obvious to Mr Neeley that there has been an “organic” response and this “thread” along with the careful documentation of results linked above making it clear enough to the average moron that MSFT or Microsoft Corporation or Bing is now attempting to mitigate damages and warrant being dropped due to responding as requested when made aware of these advisements. The nude image returning for 149 days beyond the last third-party support is long enough to prove to the average moron that the complicated step-by-step process of searching can be “organically” impacted when no longer returning two days after advised. When MSFT or Microsoft Corporation or Bing manually and “organically” cause the remaining nude to stop returning in searches; MSFT or Microsoft Corporation or Bing will be dismissed by Mr Neeley. Otherwise the maliciousness of MSFT or Microsoft Corporation or Bing will be proven. Bing technical support halfway fixed the searches for “curtis neeley” and is now given till the end of Wednesday to comply with ceasing the return of the other one nude by Neeley.
Sincerely, Curtis J Neeley Jr, MFA

Mr Neeley objected specifically to association of his name with these two nude photographs in searches. The pubic, except "bots", may see the stolen copies pulled from MSFT servers with inappropriate links at the following URL as well as this email dialog archived by date. 1. http://www.curtisneeley.com/Google/Violations-of-Privacy.html J. Mr Neeley does not feel "Bing" employees have any idea where this is coming from or how sensitive these violations are at this time. These "automatic" repairs would be very simple. MSFT employees at Bing may examine the following three links to search BING and avoid these two websites if searching for "curtis neeley" despite the fact that neither website contains the text "curtis neeley" for display to visitors. The images associated with "curtis neeley" by Bing are still present at the source websites despite the usage of "curtis neeley" was removed after the December 6 ,2010 US Court order to seek alteration in this manner. See this request at Dkt 216 of the District Court case. The "link" between these images and Mr Neeley exists exclusively because of MSFT "automated" processes from some past content. These links were removed and returned several times over the past three years by MSFT. There are "geeks" who can alter this violation overnight and have in the past as seen by numerous witnesses, Court for the Western District of Arkansas, the Eighth Circuit Court of Appeals Clerks, and numerous Supreme Court Clerks already. Refusal to cease the defamatory associations of the "curtis neeley" searches with these images amplifies the gross negligence award that will now be sought.
From: Microsoft Customer Support [mailto:SERCH.SRCH.WW.00.EN.NCO.QUE.TS.T01.SPT.00.EM@css.one.microsoft.com] Hello Curtis, We do understand where you're coming from and how sensitive this issue is. However, we cannot manually adjust what is presented on our search results page as we depend on an automatic process. Upon reviewing the images you've reported, the image are still available from the original pages specifically the image URLs. Please see information below to verify this: Query: curtis neeley Bing Query URL: Image Sources Pages: Image URLs: Again, please contact the webmasters of these pages and request to have the images taken down. Once removed, please report it back to us. We thank you for the feedback you've provided regarding our processes and system. It is the feedback like this that will drive improvements in Bing. You can also directly send your feedback by going to https://feedback.discoverbing.com and select the product of your choice. Sincerely, Cerah
Bing will either manually override and alter the HUGE database or face a jury award for neglecting this advisement and continuing to violate Neeley's privacy and associate this nude image with Neeley's name at schools. Michael "checked further" on the link to http://www.bing.com/images/search?q=curtis+neeley&view=detail&id=ABBEC5D7FF89C0D7A05C8790D16E4925E61D000D&first=0&FORM=IDFRIR and imagined a comment? Where on the page did Michael imagine finding this comment by Neeley? Visitors to the page find no comment that was only imagined by Michael at Bing. Visitors to the page do NOT see the file name for the image of "curtis_neely.jpg". Visitors do not generally see the link to {michelle7-erotica.com/members/001/0802/curtis_neeley/gallery_1.htm} although this is seen by visitors who mouse-over the image and read the link. THERE ARE ABSOLUTELY NO USES OF "curtis neeley" ON THE LINKED PAGE AND NO COMMENT, NONE AT ALL! MSFT "bots" access the webpage and were not precluded by the robots.txt. The fact that the webpage is accessible to the PUBLIC does not mean Curtis J Neeley Jr., MFA agreed to have the content copied by MSFT and associated with Neeley's personal name elsewhere like in public schools. i.e. Failing to lock a vehicle when visiting a grocery store leaves the vehicle "accessible" to the public. This failing to lock the vehicle does not request that the public intrude into the vehicle. The lack of a "lock" on this page does not seek the page's bare code being taken apart by "bots" and then represented in a new contexts at other websites. Children at school are infinitely more likely to type their father's name into MSFT searches at school. Bing will either manually override and alter the HUGE database or face a jury award for neglecting this advisement and continuing to violate Neeley's privacy and associate this nude image with Neeley's name. The following text would preclude the "bots" from violating the content of this INDIVIDUAL page. This 373 byte file is also attached. Please, Mr Gilbert, either remove Neeley's name from the page's code entirely and/or include a robots.txt like follows and like is attached? User-agent: Googlebot-Image User-agent: Googlebot User-agent: MSNBot User-agent: MSNBot-Media User-agent: MSNBot-NewsBlogs User-agent: MSNBot-* User-agent: / ================================ Thank you for the current alteration Jack Gilbert. THIS IS NOT A GAME! Sincerely, Curtis J Neeley Jr, MFA
From: Microsoft Customer Support [mailto:SERCH.SRCH.WW.00.EN.NCO.QUE.TS.T01.SPT.00.EM@css.one.microsoft.com] Hi Curtis,
I spoke with Wikimedia Foundation legal and the page MSFT links does not have the text "curtis neeley"! See "curtis neeley" searches. Links (one) and (two) will cost $300,000 or more unless manually changed NOW. Neither page has "curtis neeley" on it! MSFT does not reflect only what is published on the web like you say. I used short and clear words that are simple in case this might help? Please tell me if you know what I said and can help fix this or can refer me to a "geek" who can fix this. Sincerely, Curtis J Neeley Jr, MFA
Thank you and have a great day. Regards, Manny

Thank you, Brad
